Kodem Venkata Ramana Rao v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.8179 OF 2016
O R D E R
This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.193 of 2016 on the file of Judicial Magistrate of First class, Palakonda, registered against the petitioner/A-6, for the offence punishable under Sections 447, 506, 323 read with 34 of IPC. Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the State.
A perusal of the material on record reveals that specific allegations were made against the petitioner. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, preferably within a period of six months from the date of receipt of this order, without insisting the presence of the petitioner / accused No.6 on each and every date of hearing, unless required for any specific purpose. Miscellaneous petitions pending if any, shall stand closed. No costs. ------------------------------ M.S.K.JAISWAL,J DATE:16.06.2016 AVS
