HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33094 of 2018 ORDER:

1) Heard.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.2 in including the private land in Survey No.82, situated at Thyagarajanagar, Tirupati, Chittoor District, in prohibitory list under Section 22-A (i)(c) of Registration Act, vide letter in Rc.No.M1/9580/2016, dated 05.07.2016 and not considering the application dated 30.04.2018, for deletion of the land in the said survey from the prohibitory list, as illegal and arbitrary. 3) At the time when the matter is taken up for hearing, learned counsel for the petitioner would submit that he made a representation dated 30.04.2018, before the Commissioner of Endowments - respondent No.2, seeking deletion of land from the prohibitory list. It is stated that though he made the said representation in the month of April, 2018, till date, the authorities have not passed any orders on the same. On the other hand, his grievance is that the house which was there in the said land was demolished.

4) Learned Government Pleader would submit that if the application is still pending consideration and since the

Commissioner of Endowments - respondent No.2, is the appropriate authority to deal with the said application, respondent No.2 would dispose of the same, at the earliest, in accordance with law.

5) Having regard to the above, the Commissioner of Endowments - respondent No.2 shall deal with the representation of the petitioner, dated 30.04.2018, in accordance with law, after hearing all the concerned and pass orders, in accordance with law, as early as possible, preferably within four weeks from the date of receipt of a copy of the order.
