HON'BLE SRI JUSTICHE K. LAKSHMAN WRIT PETITION No.44719 of 2022 ORDER:

Heard Sri V. Raghunath, learned counsel appearing for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents. Perused the record. In view of the nature of relief sought by the petitioner herein, this Writ Petition is disposed of at the admission stage by dispensing with notice to respondent No.5. Petitioner herein had filed a suit vide O.S.No.264 of 2022 against respondent No.5 seeking specific performance of agreement of sale in respect of suit schedule A and B properties. Learned II Addl. District and Sessions Judge, Ranga Reddy district passed an interim order dated 28-042022 in I.A.No.472 of 2022 in O.S.No.264 of 2022 restraining respondent No.5 from alienating or creating any third party interest over the suit schedule property.

According to Sri V. Raghunath, learned counsel appearing for the petitioner, the said suit is pending and the aforesaid injunction is subsisting as on today. The said fact

was intimated to respondent No.3 vide written representation dated 31-10-2022. Despite receiving and acknowledging the said written representation, respondent No.3 did not act upon the same, therefore, the present writ petition. Whereas learned Assistant Government Pleader for Revenue, on instructions, would submit that respondent No.3 will consider the said written representation submitted by the petitioner and pass appropriate orders, in accordance with law.

In view of the aforesaid submissions and also nature of relief sought by the petitioner, this writ petition is disposed of, directing respondent No.3 to consider the aforesaid representation dated 31-10-2022 submitted by the petitioner and copy of the aforesaid injunction order and pass appropriate orders, in accordance with law. There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed. __________________ K. LAKSHMAN, J December 14, 2022 PN
