THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2739 OF 2016 ORDER:

This Criminal Petition is filed by the accused No.6 & 7 under Section 482 of Cr.P.C. seeking to quash the proceedings in Crime No.6 of 2016 on the file of Indrakaran Police Station, Sanga Reddy, Medak District.

On perusal of the entire material available on record, prima facie there are some allegations as against the petitioners and truth or otherwise of the said allegations can be ascertained by the investigating agency during the course of investigation and this Court is not inclined to quash the proceedings in the said crime at this stage. It is submitted that the petitioners have already obtained bail.

In the circumstances, the petitioners are at liberty to approach this Court on filing of charge sheet, if they are aggrieved over the same, for quashing the proceedings. Till filing of the charge sheet, the presence of the petitioners before the trial Court is dispensed with.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
