THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14735 of 2025 This Criminal Petition is filed before this Court for grant of bail to the Petitioner who arrayed as accused No.5 in FIR No.401 of 2025 of Shankarpally Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 310(2), 324(3), r/w 3(5) of the Bharatiya Nyaya Sanhita (for short 'BNS').

The brief facts of the case are that, on 12.09.2025, the de-facto complainant lodged a report before the police stating that the petitioner, along with other accused, conspired to rob a substantial amount of money from him. According to the complaint, Accused No.1 drove the vehicle used in the crime, and the petitioner, along with the other accused, intercepted the car of the complainant by overtaking and colliding with its front right side. They then allegedly incapacitated the driver by sprinkling chilli powder into his eyes and forcibly took a cash bag containing Rs.40,00,000/-. Following the robbery, the vehicle of the accused met with an accident, and the police, arriving promptly at the scene, arrested the accused

and seized their car. Based on this complaint, a case was registered against the petitioner and the other accused for the aforementioned offences.

Heard Sri M. P. K. Aditya, learned counsel appearing on behalf of the petitioner as well as Sri E. Ganesh, learned Assistant Public Prosecutor for respondent-State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the case merely on the ground of his acquaintance with accused Nos.1 to 4. He further submitted that the petitioner has been in judicial custody since 13.09.2025 and that the substantial part of the investigation has already been completed and that the other co-accused have been granted bail. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that there are specific allegations leveled against the petitioner. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is in jail from 13.09.2025 and other accused were granted bail and as seen from the record LWs.1 to LW26 are examined including the investigation authority.

Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, this Court finds it appropriate to grant bail to the petitioner/accused No.5, subject to the following conditions:

i.

The petitioner/accused No.5 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Judicial Metropolitan Magistrate at Chevella, Rangareddy District.

ii.

The petitioner/accused No.5 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for

the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/accused No.5 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
