THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.5404 of 2012 ORDER:

Neither is the learned counsel for the petitioner present nor is there any representation on his behalf.

The proceedings under challenge in this writ petition is a notice issued by the Tahsildar dated 04.02.2012 calling upon the petitioner to pay Rs.43,960/-.

The impugned notice is, allegedly, to repay the excess amount paid towards scholarship. This proceeding, though couched as a notice, is an order directing the petitioner to pay the said amount. Admittedly, the petitioner was not given an opportunity to show cause or to put forth their objections to such a demand.

The impugned order is set aside. It is made clear that this order shall not disable the respondents from putting the petitioner on notice, give them an opportunity of being heard; and, thereafter, to take action in accordance with law.

The Writ Petition stands disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
