HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.7044 OF 2017 ORDER:

The case of the petitioners is that the Assistant Director of Survey and Land Records-3rd issued proceedings vide Lr.No.A3/1933/2016, dated 20.12.2016 to the petitioners stating that the survey and demarcation of the subject lands could not done as the civil suit pertaining to said lands is pending before the Senior Civil Judge, Zaheerabad. Aggrieved by the said proceedings, the present writ petition is filed.

Learned counsel for the petitioners submits that not withstanding the pendency of the suit, the survey authorities can conduct survey and demarcate the subject lands.

Heard the Assistant Government Pleader for Revenue. In this case, it is to be seen that a civil suit is pending between the petitioners and the unofficial respondents and that the Civil Court has already granted order of statusquo. If petitioners feels that it is required to conduct survey and demarcate the subject lands, they can very well approach the Civil Court by making necessary application and the Civil Court has always power to order such applications.

With the above observations, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 01.03.2017 dv
