HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44587 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to declare the action of the respondents in registering Crime No.256 of 2016, on the file of the Pendurthy Police Station, as illegal and arbitrary and consequently to quash the same.

Heard and perused the material available on record. The 5th respondent lodged the present complaint against the petitioners alleging that the marriage between the 1st petitioner and the 5th respondent occurred on 03.04.2016 and that the 1st petitioner, along with his family members, are harassing the 5th respondent, both physically and mentally, by demanding additional dowry. Basing on the said complaint, the 4th respondent registered the same as Crime No.256 of 2016 for the offences punishable under Section 498-A IPC and Sections 3 & 4 of the Dowry Prohibition Act.

The main grievance of the petitioners is that the 4th respondent is harassing the petitioners on one pretext or the other by calling them to the police station in odd hours and that the 4th respondent police are frequently visiting the house of the petitioners and threatening to arrest the petitioners. Considering the grievance of the petitioners, the 4th respondent is directed to complete the investigation in Crime No.256 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to execute personal bond for a sum of Rs.

surety for the like sum each to the satisfaction of the 4th respondent as surety for their future appearance for the purpose of investigation.
