THE HON'BLE SRI JUSTICE T.AMARNATH GOUD CRIMINAL PETITION No.8034 OF 2011 ORDER:

This Criminal Petition is filed by the petitioner/A4, under Section 482 Cr.P.C., to quash the proceedings in Crime No.44 of 2011, dated 15.05.2011, of Samisrigudem Police Station, West Godavari District, registered for the offences punishable under Sections 427, 468, 471, 448, 420, 511 r/w 34 IPC.

Heard learned counsel for the petitioner and learned public prosecutor, representing the 1st respondent - State and perused the entire material on record.

The brief facts of the case in nutshell are as follows: The defacto complainant/2nd respondent herein - Chairperson of World Missionary Evangelism of India (Regd.No.182/1969), a Christian organization, having purchased an extent of Acres 2.02 cents land in Survey Nos.323 and 326/4, vide document Nos.152, 153 and 566 of 1976, constructed an orphanage home in the name and style "Douglas Memorial Children Home" and to his surprise, in the month of March 2011, the said building was dismantled and on the personal enquiries made by him, he suspected seven persons and accordingly, filed a complaint before the Station House Officer, Samisrigudem, Nidadavole Mandal, West Godavari District.

On perusal of the proceeding sheet, it is evident that this Court, on 07.09.2011, granted interim stay of all further proceedings in connection with Crime No.44 of 2011. Instead of keeping the matter pending for a long time, this Court feels it just to dispose of the criminal petition with a direction to the police to complete the investigation.

Accordingly and in the result, this criminal petition is disposed of, with a direction to the police to complete the investigation, as expeditiously as possible. It is needless to say that the police shall not arrest the petitioner during the investigation, however, this order will not preclude the police to secure the presence of the accused, as and when necessary, for purpose of investigation.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
