THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.15356 of 2024 ORDER:

This Criminal Petition is filed under Section 483(1)(b) of Bharatiya Nagarik Suraksha Sanhita, 2023 to relax/modify the condition No.IV in para 9 of the order dated 07.11.2024 i.e., the petitioner/accused shall before the investigating agency on every Monday and Friday for a period of 3 months or till the fling of charge sheet, whichever is earlier" passed by the XII Additional Chief Judicial Magistrate, Hyderabad in Crl.M.P.No.4561 of 2024 in Crime No.190 of 2024. 2.

Heard Sri Baglekar Akash Kumar, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent.

Learned counsel for petitioner submitted that the petitioner/accused No.2 has been complying with the aforesaid condition from the date of order. He further submitted that though the entire investigation is completed, just to harass the petitioner/accused No.2, the Police are making the petitioner

SKS,J Crl.P.No.15356 of 2024 to sit in the Police Station from morning 11.00 a.m. to till night 9:00 p.m. and prayed the Court to relax the said condition.

Having regard to the submissions made by the learned counsel for the petitioner, this Court is inclined to relax the condition No.IV in para 9 of the order dated 07.11.2024 passed in Crl.M.P.No.4561 of 2024 by the learned XII Additional Chief Judicial Magistrate, Hyderabad. However, the petitioner is directed to appear before the Police concerned whenever his presence is specifically required. 5.

With the above relaxation, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall also stand closed.
