THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.17307 of 2015 ORDER:

This writ petition was filed with the following prayer: "It is therefore prayed that this Hon'ble Court may be pleased to issue a writ of Mandamus or any other appropriate Writ, Order or Orders, Direction or Directions to declare the impugned order passed by respondent No.3 in not returning the licensed Pistol bearing No.618445 made in Czechoslovakia with License No.A/65/CTR/2013, valid up to 9.12.2016 to the petitioner herein as illegal, arbitrary and contrary to the provisions under Arms Act, 1959 and Arms Rules, 1962 and to pass such other or orders as this Hon'ble Court may deem fit just and proper in the circumstances of the case and in the interest of justice."

It is however stated by the learned Assistant Government Pleader for Home that the licence of the petitioner was suspended by the licensing authority under proceedings dated 25.01.2016. A copy of the proceedings of the District Collector, Chittoor, in Roc.C4/1450/2015 dated 25.01.2016 is placed on record and perusal thereof reflects that the petitioner's arms licence was suspended in exercise of powers under Section 17(3)(b) of the Arms Act, 1959. Sri Vinod Kumar Deshpande, learned Senior Counsel appearing for the petitioner, states that the said proceedings are yet to be communicated to his client.

However, in the light of this development, the cause in this writ petition no longer survives for adjudication on merits. The writ petition is accordingly dismissed leaving it open to the petitioner to take appropriate steps in accordance with law if he is aggrieved by the proceedings dated 25.01.2016 of the licensing authority. The learned Assistant Government Pleader for Home shall furnish a copy of the said proceedings to the learned counsel on record for the petitioner.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
