THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5777 OF 2016 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.14 of 2012 on the file of the Principal Special Judge for CBI Cases, Hyderabad, arising out of offences under Sections 120-B, 420 and 409 IPC and Section 13(2) read with Section 13(1)(c) and (d) of the Prevention of Corruption Act, 1988.
Heard and perused the material available on record. Learned counsel for the petitioner, after arguing for sometime, confines his argument with regard to dispensing with the presence of the petitioner before the Court below. He further submits that even though the petitioner filed discharge application long back before the Court below and also arguments are over, the Court below has not passed any order in the said application.
Considering the facts and circumstances of the case, the presence of the petitioner herein is dispensed with except on the dates when the trial Court insists for his appearance. The petitioner shall be represented through his counsel before the Court below on all hearing dates. The Court below is directed to dispose of the discharge application as early as possible, preferably within a period of three months.
The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 21.04.2016 pln
