THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.3256 of 2015

ORDER

The petitioner filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.87 of 2014 of Chitvel Police Station, Kadapa District, registered for the offences punishable under Section 379 IPC and under Sections 20(1)(a)(2)(3)(6) and 29(4)(b) of A.P.Forest Act, 1967 and Rule 3 of Red Sanders and Sandal Wood Forest Rules, 1969 and under Section 3 of PDPP Act.

2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State.

3. Learned counsel for the petitioner submits that the petitioner is likely to be shown as accused in the aforesaid crime and he apprehends arrest.

4. Learned Additional Public Prosecutor, on instructions, submits that the petitioner is not shown as an accused till date.

5. A perusal of the material placed before this Court does not anywhere indicate that the petitioner is shown as accused in the aforesaid crime. In view of the above, I am of the view that the present application is not maintainable.

6. Accordingly, the Criminal Petition is disposed of, leaving it open to the petitioner to avail the remedies available under law, if he is shown as accused in the aforesaid crime. Miscellaneous petitions, if any, pending in this petition shall stand closed.
