THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.21102 of 2016 ORDER: (Per Justice Sanjay Kumar) This writ petition was filed assailing the possession notice dated 05.05.2016 issued by the Andhra Bank under Rule 8(1) of the Security Interest (Enforcement) Rules, 2002.

As the petitioners failed to deliver possession voluntarily, the Andhra Bank initiated measures under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short, 'the SARFAESI Act'), and the petitioners filed W.P.No.25837 of 2016 assailing the order passed by the Collector and District Magistrate, West Godavari District, in exercise of power under Section 14 of the SARFAESI Act.

As W.P.No.25837 of 2016 was dismissed by this Court today vide a separate order, the cause in this writ petition does not survive for consideration.

The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
