O R D E R
Heard the learned counsel for the petitioners and the learned Government Pleader for respondents.
This writ petition is filed challenging the action of the respondents, more particularly 4th respondent, in not issuing possession certificates to the petitioners pursuant to pattas already issued by proceedings 27.08.2016 in favour of the petitioners in an extent of 03 cents each in Sy.No.91-1A& 2, situated at Timmarajupalem village, Purchur Mandal, Prakasam District, A.P. As per the counter affidavit filed by the 4th respondent, it is admitted that after cancellation of house site pattas of 104 persons on the ground of violation of patta conditions, house site pattas were granted to 29 persons residing in Thimmarajupalem village on 27.08.2016, including the petitioners. As per circular instructions of the Project Director, A.P. Housing Corporation Limited, Ongole dated 17.06.2017, in order to proceed for construction of houses under N.
T.R. Rural Housing, pattas/ possessions certificates are essential to know the boundaries of the site of the beneficiary and to confirm whether the site belongs to the beneficiary or not. It is admitted that house site pattas were issued, but the possession certificates were not issued, as it was felt not necessary.
In view of the admission made by the 4th respondent with regard to issuance of house site pattas, but non-issuance of possession certificates, which are essential in view of circular instructions of Project Director of A.P. State Housing Corporation dated 17.06.2017, this writ petition is allowed directing the 4th respondent to issue possession certificates in tune with the patta certificates already issued in favour of the petitioners, within a period of four weeks from the date of receipt of a copy of this order.
Miscellaneous petitions pending if any, shall stand closed. No order as to costs.
