HON'BLE SRI JUSTICE P. KESAVA RAO WRIT PETITION No.30716 of 2014 ORDER :

The relief sought in the writ petition is as under: "..... this Hon'ble Court may be pleased to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus by declaring the inaction of the respondents 1 to 4 as illegal, arbitrary for not taking action on the complaint of the Petitioner dated 01.09.2014 against the respondent Nos.5 to 8 herein for their illegal acts and for their tresspass and their illegal acts and deeds in obstructing the petitioner and his family members movement into their agricultural lands situated in Sy.No.69/1 and 134/2 through their own land in Sy.No.83-2/1 of Kariwarala Village, Nadigudem Mandal, Nalgonda District, and consequently direct the respondents 1 to 4 to take action against the unofficial Respondents Nos.5 to 8 not to interfere into the lands of the petitioner and his wives and to pass such other order or orders ....."

Heard learned counsel for the petitioner as well as the learned Government Pleader for Home appearing for respondent Nos.1 to 4.

Learned Government Pleader for Home placed on record written instructions dt.23.12.2019 issued by the SubInspector of Police, Nadigudem Police Station, Suryapet District.

From a perusal of the said instructions, it is revealed that the petitioner sent a complaint dt.01.09.2014 to respondent No.4 through registered post, wherein he has stated that his neighbours Sri S. Srinivasa Rao and others are

PKR,J W.P.No.30716 of 2014 obstructing him from entering into his lands and their path of land and also trying to grab his land, apart from tried to kill him by entering into his lands. On receipt of the said complaint, a case in Crime No.154 of 2014 of Nadigudem Police Station, for the offences punishable under Sections 447, 341, 506 r/w. Section 34 of IPC was registered on 03.11.2014. In the said instructions, it is also mentioned that after completion of investigation, a Charge Sheet was filed before the Judicial First Class Magistrate, Kodad, and the case was numbered as C.C.No.45 of 2015. However, later the said case was re-numbered as C.C.No.831 of 2018, which is pending trial.

Having regard to the above said facts, since the grievance of the petitioner is redressed in the form of registration of Crime No.154 of 2014, completion of investigation and filing of Charge Sheet, this Court is of the opinion that no further cause would survive in the present writ petition.

Accordingly, this writ petition is closed. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
