HON'BLE SRI JUSTICE A.RAJASHEKER REDDY REVIEW WPMP.No.22011 of 2012 And WRIT PETITON No.23677 OF 2011 COMMON ORDER:

The review MP is filed by the official respondents in the main writ petition against the order dated 02-01-2012 in WP.No.23677 of 2011, wherein this Court directed the 3rd respondent in the writ petition to entertain the document presented by the writ petitioner in respect of the subject lands without insisting on submission of No Objection Certificate.

Heard learned Assistant Government Pleader for revenue, who submits that by the time writ petition is filed, the writ petitioner is no more and died on 08-03-2010. Heard Sri C.Ramesh Sagar, Counsel appearing for the respondents 2 to 7 in the review MP, who are the legal heirs of writ petitioner, submits that the mother of the respondents 2 to 7 never filed writ petition and by the time the writ petition is filed, their mother expired on 08-03-2010. Both counsel state that the order under review is liable to be set aside.

In view of facts and circumstances of the case, the review MP is allowed and consequently, the order dated 02-01-2012 passed by this Court in WP.No.23677 of 2011 is recalled.

Accordingly, the WP.No.23677 of 2011 is dismissed. However, this will not preclude the respondents 2 to 7 in the review MP to agitate their rights in accordance with law. _________________________ A.RAJASHEKER REDDY,J 06-12-2016 nvl
