O R D E R
The learned Assistant Government Pleader for Revenue, by producing copy of the proceeding dated 27.02.2018, issued by the respondent - Tahsildar, Huzurganar, submits that in compliance of the order of this court dated 18.01.2017 in W.P.No.43690 of 2016, the application of the petitioner for issuance of duplicate pattadar pass books, has been considered and after conducting enquiry, as it was found that the petitioner was not in possession of the subject property and that the subject land is being used for non‐agricultural purpose, petitioner was informed that it is not possible for issuance of pattadar pass books and accordingly the said proceedings was issued. He submits that the respondent by issuing proceedings dated 27.02.2018, has complied with the order of this court.
On the representation made by the learned Assistant Government Pleader for Revenue that the order passed by this court has been complied with, learned counsel for the petitioner, on the last two occasions, has taken adjournments, for instructions from the petitioner. Today, there is no representation for the petitioner. In view of the above submissions of the learned Assistant Government Pleader for Revenue that the respondent has complied with the order of this court by issuing proceedings dated 27.02.2018, I do not find any willful violation and the contempt case is accordingly dismissed.
However, it is always open for the petitioner to challenge the proceedings dated 27.02.2018 in accordance with law.
