This Writ Petition is filed to declare the action of the respondents in issuing the impugned notice dated 10.03.2013 terminating the lease of the petitioners over the temple lands as illegal and arbitrary. The case of the petitioners is that they are the landless poor persons and cultivating the lands belonging to the fourth respondent temple since more than 70 years; the lease is subsisting as on the date of commencement of the A.P. Charitable and Hindu Religious Institutions and Endowments Act, 1987 (for short 'the Act') and that they are entitled to get the benefit of Section 82 (2) of the Act which is available to the landless poor lessees; they made several representations to the respondents to renew the lease, but the respondents terminated the lease under the impugned notice.
No interim order is passed in this Writ Petition. As seen from the material papers filed along with the Writ Petition, the petitioners filed a representation to the Assistant Commissioner, Endowments Department, Rajahmundry, East Godavari district, stating that their lease has to be extended for the period from 2012-13 to 201516, as per G.O.Rt.No.969, dated 17.07.2009. As the said period has also expired due to afflux of time, no further orders are necessary in the Writ Petition.
The Writ Petition is, accordingly, closed. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
