THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRP No.2840 of 2016 ORDER:
This Civil Revision Petition is filed under Article 227 of the Constitution of India assailing the order dated 30.04.2016 passed in I.A.No.157 of 2016 in CMA No.9 of 2013 on the file of the Court of the Principal District Judge, Vizianagaram.
At the time of arguments, the learned counsel for both parties submitted that the suit is pending from 2012 onwards. Both counsel with one voice submitted that the trial court may be directed to dispose of the main suit as expeditiously as possible. In view of the submissions made by both counsel, this court is not inclined to go into the merits of the main case.
Having regard to the facts and circumstances of the case, the learned Principal Junior Civil Judge, Vizianagaram is hereby directed to dispose of O.S.No.110 of 2012 as expeditiously as possible, at any rate, within a period of three months from the date of receipt of a copy of this order. If the parties will not cooperate with the trial court in disposing of the suit, the trial court is at liberty to proceed in accordance with law.
The Civil Revision Petition is accordingly disposed of. No order as to costs. As a sequel, miscellaneous petitions, if any pending in this petition shall stand closed.
