O R D E R
The case of the petitioner, as per the averments made in the affidavit filed in support of the writ petition, is that through District Employment Exchange, she was appointed as daily wage worker on 1.9.1983 and posted to Government Scheduled Caste Girls Hostel, Sultanabad of Karimnagar District and since then she has been continuously working and presently working at Government Scheduled Caste Boys Hostel, Ganneruvaram, Karimnagar District. The 3rd respondent - Director of Scheduled Caste Development Department issued seniority list of daily wage workers on compassionate grounds and victims of atrocities for effecting promotions to Class IV employees. The case of the petitioner is that though she was not appointed on compassionate grounds, her name was also included in the said list at serial no. 18, with a wrong date of appointment as 1.
7.1992 instead of 1.9.1983. Due to wrong entry of date of her appointment, she was ignored for regularization, though she has been working since 1.9.1983. Aggrieved by the same, she filed writ petition in W.P.No.13490 of 2002 and this court by order dated 24.08.2009 directed the respondents to consider her case for regularization in terms of G.O.Ms.No.212 Finance and Planning dated 22.4.1994 and G.O.(P) No.112 Finance and Planning dated 23.07.1997. The 5th respondent - Deputy Director, Social Welfare vide speaking orders dated 23.1.2010 informed the petitioner that her case for regularization as class-IV employee would be considered as and when future vacancies arise according to the seniority and eligibility.
shown as appointed on compassionate grounds with wrong date of appointment, she made a detailed representation dated 6.10.2015 to the 4th respondent to rectify the error crept in seniority list of appointments made on compassionate and on other grounds. As there was no response, she made another representation dated 18.10.2016. While things stood, the 4th respondent issued final seniority list of Daily Wage Workers in Karimnagar District working in Government Social Welfare Hostels sponsored by Employment Exchange. To the surprise of the petitioner, the name of the petitioner does not find place in the said list. The grievance of the petitioner is that the services of one Smt. M.Odamma who was also appointed as daily wage worker through employment exchange on 1.9.1983 were regularized by the 4th respondent vide proceedings No.
A2/411/2015-5 dated 11.8.2017, but the services of the petitioner were not regularized. Aggrieved by the said action of the 4th respondent, the present writ petition is filed. Heard the learned counsel for the petitioner, who reiterated the above writ averments and the learned Assistant Government Pleader for Social Welfare.
Having regard to the above averments and the submissions of the learned counsel, the writ petition is disposed of directing the 4th respondent - District Collector, to consider the representations of the petitioner dated 6.10.2015 and 18.10.2016, by taking into consideration the above averments and pass appropriate orders in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No order as to costs.
