Sri Veerabhadra Swamy Fertilizers And Pesticides, v. The State Of A.P.

HONOURABLE SRI JUSTICE CHALLA KODANDA RAM W.P.No.21260 of 2016 ORDER:

This writ petition is filed seeking to declare the action of respondents 3 and 4 in returning the application of the petitioner for renewal of Form-A2 licence of Sri Veerabhadra Swamy Fertilizers and Pesticides, Kalyandurg, as arbitrary and illegal. Petitioner is the proprietor of Veerabhadra Swamy Fertilizers and Pesticides, Kalyandurg. He was granted Form-A2 licence in the year 1985. Since then, the licence was renewed from time to time and it is valid upto 24.4.2016. While so, when his certificate of registration has expired by 1st week of May, 2016, the petitioner submitted an application along with challan for renewal, but the 4th respondent returned the same. Pursuant to the same, the petitioner filed a petition before the 3rd respondent, but so far, no action has been taken thereon.

The grievance of the petitioner is that without assigning any reasons, the 4th respondent returned his application, which was filed for renewal. In view of the same, respondents 3 and 4 are directed to consider the renewal application of the petitioner and pass appropriate orders thereon within a period of four weeks from the date of receipt of a copy of this order. If, for any reasons, the said

application is not considered, they shall communicate the same to the petitioner.

Writ Petition is accordingly disposed of. No costs.

Miscellaneous petitions pending, if any, shall stand closed.
