THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38253 of 2016 ORDER:

This writ petition is filed seeking to call for the records in FIR No.24 of 2016 and to quash the same.

Heard and perused the material available on record. The case of the petitioner is that he is the owner and possessor of Ac. 0.04 cents of land in Survey No.103/2 of Cheemalapenta Village, Lingasamudram Mandal, Prakasham District. One Karanam Abbaiah tried to interfere with the possession and enjoyment of the subject land of the petitioner and that the petitioner has filed a suit in O.S.No.191 of 2016 seeking injunction and he has obtained an Ad-interim injunction restraining the said Karanam Abbaiah in I.A.No.1166 of 2016 and that the said Karanam Abbaiah, who want to knock away the property of the petitioner, influenced the 3rd respondent, who works as a V.R.O.

, and the 3rd respondent gave a false complaint against the petitioner before the 2nd respondent as if the NOC issued by him is a forged one basing on which the petitioner obtained Ad-interim injunction. The main grievance of the petitioner is that if the petitioner is forced to face the prosecution, then he would be put to grave and irreparable loss. Considering the grievance of the petitioner, the 2nd respondent is directed to complete the investigation in FIR No.24 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. The petitioner is directed to execute a personal bond for a sum of Rs.

5,000/- (Rupees five thousand only) with one surety to the satisfaction of the 2nd respondent as surety for his future appearance as and when required for the purpose of investigation.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
