HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18498 OF 2012 O R D E R :

This writ petition is filed declaring the action of the respondents in not considering the case of the petitioner for interview and test for the post SAFAI KARAMCHARI/WATER BOY/LUNCH ROOM ATTENDANT scheduled on 25.06.2012 on the ground that the name of the petitioner is not sponsored by the 2nd respondent, as illegal and arbitrary and for a consequential direction to the 1st respondent to permit the petitioner for written test and selection process.

This Court on 21.06.2012 granted interim order which reads as follows:

"In the light of the recent judgment of the Supreme Court in State of Bihar v. Upendra Narayan Singh and others (2009 (5) SCC 65) the employer even if he opts to entertain candidates sponsored by the Employment Exchange must also advertise and call for applications from eligible candidates so as to give an opportunity to all those who fulfil the requirements. In the present case, the complaint is that the State Bank of Hyderabad is only limiting its recruitment process to those sponsored by the Employment Exchange. Interviews in this regard are scheduled to be held on 26.06.2012.

There shall accordingly be a direction to the bank to receive the applications of the petitioner herein and subject them to the selection process along with others on 26.06.2012 and also publish a notification in the newspapers calling for applications from all eligible candidates for filling up the posts of Safai Karamchari-cum-water boys, receive applications from eligible candidates and also subject them to the selection process."

Heard both sides.

Interim prayer and the main prayer sought in the writ petition is one and the same. Since the relief sought for in the writ petition is already granted by way of interim order, the writ petition is disposed of interms of the interim order dated 21.06.2012. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
