THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.9294 of 2017 ORDER:

This petition is filed, by the petitioner-accused No.3, under Section 438 Cr.P.C., seeking anticipatory bail in Crime No.311 of 2016 on the file of the Station House Officer, Chaderghat Police Station, Hyderabad, registered for the offences punishable under Sections 406, 420, 468 and 471 read with 34 I.P.C. 2.

The learned counsel for the petitioner submitted that the petitioner has nothing to do with the alleged offences. He further submitted that the petitioner was falsely implicated in this case. 3.

The learned Additional Public Prosecutor submitted that the petitioner along with other accused fabricated different documents and cheated the bank.

The case of the prosecution is that the petitioner along with other accused created fake documents. It is the further case of the prosecution that basing on those documents, accused Nos.1 and 2 obtained loan from the bank. The gist of the allegations made in the complaint is that the petitioner herein along with the other accused cheated the bank. The petitioner filed Crl.M.P.No.2762 of 2017 on the file of the Court of the Additional Metropolitan Sessions Judge for trial of communal offences cases-cum-VII Additional Metropolitan Sessions Judge, Hyderabad, and the same was dismissed on 07.09.2017.

A perusal of the record reveals that the petitioner along with the other accused created fake documents and supplied the same

to accused Nos.1 and 2. The record further reveals that accused Nos.1 and 2 obtained the bank loan basing on the fake documents supplied by the petitioner and other accused. A perusal of the record prima facie reveals the role played by the petitioner in the commission of the offences.

Taking into consideration the gravity of the offences alleged to have been committed by the petitioner as well as the stage of investigation, this Court is of the considered view that it is not a fit case to grant pre-arrest bail to the petitioner. 7.
