THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.474 of 2014 ORDER:
The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Cr.No.709 of 2013-14 of Prohibition & Excise P.S, Warangal Urban, Warangal District, registered for the offences punishable under Rule 27(1) of A.P.Excise (Grant of License to Sell Toddy Conditions of Licenses and Tapping of Excise Trees) Rules, 2007.
Heard the learned counsel appearing for the petitioners/A1 to A11 and the learned Additional Public Prosecutor, representing the State.
Specific allegations were made against the petitioners in the complaint. This is a matter which requires investigation by the police. The truth or otherwise of the allegations can only be decided during course of investigation or trial. I see no ground to quash the first information report.
The learned Additional Public Prosecutor submitted that the investigation in the above crime is completed and charge sheet is yet to be filed.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the Criminal Petition is disposed of, giving liberty to the petitioners/A1 to A11 to avail other remedies that are available under law.
Pending miscellaneous applications, if any, shall stand closed in consequence.
