Counsel for the Petitioner: Mr.S.Appadhara Reddy Counsel for the respondent: AGP for Irrigation and CAD (TS) The Court made the following:

Order:

This Writ Petition is filed for a Mandamus to declare the action of the respondents in interfering with the petitioner's peaceful possession and enjoyment of her land admeasuring Acs.4-02 guntas in Survey No.62 of Aswaraopet Village and Mandal, Khammam District, as illegal and arbitrary. At the hearing, the learned Assistant Government Pleader for Irrigation (TS), has placed before the Court, the written instructions received by him from the Deputy Executive Engineer, I.B.Sub Division, Aswaraopeta, wherein it is stated that the land in RS.No.62 was an agricultural land; that the same was converted by the petitioner for non-

agricultural purpose, for which the tail end ayacutdars, whose lands were being irrigated by the canal passing through the petitioner's land, have objected; that after filing of this Writ Petition, the petitioner has negotiated with the tail end ayacutdars and settled the dispute amicably by providing alternative way for running the canal; and that in view of the same, the respondents are not interfering with the petitioner's enjoyment of the above-mentioned land.

The above-submission of the learned Assistant Government Pleader is placed on record and the Writ Petition is disposed of as infructuous. As a sequel to disposal of the Writ Petition, interim order, dated 13-07-2012, is vacated and WPMP.No.27213 of 2012, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 19th August, 2015 LUR
