THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.32720 OF 2018 ORDER :

Heard learned counsel for the petitioner, learned Government Pleader for Endowments and Smt.K.Lalitha, learned Standing Counsel, apart from perusing the entire material available on record.

Admittedly, petitioner herein filed O.A.No.597 of 2017, on the file of the A.P.Endowments Tribunal, Amaravathi, Pedakakani, Guntur, questioning the notification issued by the Commissioner of Endowments Department, Gollapudi, Vijayawada, Krishna District-second respondent herein, dated 22.07.1969, and the same is pending consideration. When the matter is taken up, a preliminary objection, as to the maintainability of the Writ Petition, is taken by the learned Standing Counsel, by contending that, when the O.A. is pending consideration before the Tribunal, it is not open for the petitioner herein to file the present Writ Petition before this Court. On hearing the above objection, a request is made by the learned counsel for the petitioner that the petitioner herein may be permitted to file an Interlocutory Application in the said O.A., before the Tribunal, seeking appropriate relief.

In view of the above, Writ Petition is disposed of, leaving it open for the petitioner herein to file an appropriate application in O.A.No.597 of 2017, pending on the file of the A.P.Endowments Tribunal, Amaravathi, Pedakakani, Guntur. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
