THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41749 OF 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the second respondent in summoning the petitioners herein and the parents of the second petitioner to the police station and threatening to secure the presence of the petitioners herein without any lawful reason, as illegal and arbitrary, and consequently, to direct the second respondent to provide police protection to the petitioners herein since there is a threat to their lives in the hands of the respondents herein.

Heard and perused the material.

Learned counsel for the petitioners submits that the petitioners loved each and got married in Arya Samaj as their parents refused the proposal of their marriage. He further submits that when the petitioners are leading their marital life happily, the parents of the first petitioner influenced the second respondent to break the relationship of the petitioners and as such, the second respondent is calling the petitioners and parents of the second petitioner to the police station and threatening them with dire consequences. He further submits that there is a serious threat to the lives of the petitioners from the respondents herein and as such, seeks to provide police protection to the petitioners' lives. Learned Assistant Government Pleader for Home (Andhra Pradesh) submits that the third respondent is not interfering with the family affairs of the petitioners.

Considering the rival submissions of the learned counsel for the petitioners and the Assistant Government Pleader for Home (Andhra Pradesh), and also considering the facts and circumstances of the case, the third respondent is directed not to involve in the family disputes

between the petitioners and the fourth respondent, and also not to call the petitioners herein and parents of the second petitioner to the police station and not to threaten them in any manner. The third respondent is directed to give police aid to the lives of the petitioners and parents of the second petitioner if there is any necessity, and also to follow due process of law laid down in Code of Criminal Procedure.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.12.2016 pln
