THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2643 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/ A-2 to A-5 in C.C.No.733 of 2014 on the file of IV Metropolitan Magistrate, Cyberabad at Ibrahimpatnam, arising out of Crime No.244 of 2014 of Ibrahimpatnam Police Station, Cyberabad, registered for the offences punishable under Sections 498 A, 406 and 506 IPC and Sections 3, 4 and 6 of Dowry Prohibition Act. Heard the learned counsel for the petitioner and the learned Public Prosecutor for the respondents.

Admittedly, after completion of investigation, the police filed the charge sheet before the concerned Court and a cognizance was taken by the court for the alleged offences against the petitioners and A-1. On perusal of the material on record, it is evident that prima facie, there are specific instances against the petitioners involving their active involvement in the commission of the offences, much less the alleged offences of cruelty and harassment. Whether the petitioners have committed the alleged offences or not is a matter to be decided by the trial Court after a due trial and the same cannot be determined at this stage, as this Court cannot sit as a fact finding court. However, the petitioners are at liberty to file a discharge application raising all the points as raised herein and on filing such application, the trial Court may consider the same and pass appropriate orders in accordance with law.

Accordingly, the Criminal Petition is dismissed. As a sequel thereto, miscellaneous petitions, if any, pending, shall stand

closed.
