HONOURABLE SRI JUSTICE N.V.SHRAVAN KUMAR WRIT PETITION(TR) No. 1232 OF 2017 ORDER:

This writ petition(TR) has been filed seeking to "declare the action of the respondents in not regularizing the services of the applicant in any post in Last Grade Service as illegal irregular arbitrary discrimination and violation of said orders of the Honble Supreme court and constitutional provisions and consequently direct the respondents to regularize the service of the applicant to any post in last grade service in terms of the orders issued in G O Ms No.212 Finance and Planning Department dated 22.4.1994 and the Hon'ble Supreme Court judgment dated 6.9.2009 in Civil AppeaI No.3702 of 2006 and batch with all consequential benefits such as pay fixation and arrears".

Today when the matter was taken up for hearing, learned counsel for the petitioner submits that the present case is squarely covered by the orders passed by the Hon'ble Supreme Court in State of Karnataka V. Umadevi1 and others; and Division Bench of this Court passed in WP No.10942 of 2009, dated 29.08.2022.

Sri S.Surender Reddy, Learned Standing Counsel for Municipalities appearing for the respondents has fairly acceded the above facts and submits that respondent authorities may be directed to consider the case of the petitioner in terms of orders passed by the Hon'ble Supreme Court in 1 2006(4) SSC1

State of Karnataka V. Umadevi and others; and Division Bench of this Court passed in WP No.10942 of 2009, dated 29.08.2022. 4.

In view of the submission made by the learned counsel on either side, this Writ Petition(TR) is disposed of, with a liberty to the petitioner to make a fresh representation to the respondent authorities within a period of two(2) weeks from the date of receipt of copy of this order and thereafter the respondent authorities are directed to consider the petitioner's representation in terms of orders passed by Hon'ble Apex Court in State of Karnataka V. Umadevi and others; and Division Bench of this Court passed in WP No.10942 of 2009, dated 29.08.2022 and pass appropriate orders in accordance with law, as expeditiously as possible, preferably within a period of eight (08) weeks from the date of receipt of said representation and communicate the same to the petitioner. 5.

Accordingly this writ petition(TR) is disposed of. Miscellaneous applications, if any pending, shall stand closed.
