HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.32664 of 2018 ORDER:

This Writ Petition is filed seeking the following relief: "to grant appropriate relief more in the nature of Writ of Mandamus under Article 226 of the Constitution of India declaring the action of the 1st Respondent in not taking any action and not considering the representation/complaint made by the Petitioner on 18.08.2018 as well as not only allowing the party respondent No 4 to enter into the Petitioners land to the extent of 600 sq yards in survey No 513 but also allowing the 4th Respondent to make construction apart from preventing the Petitioner from entering into his land as arbitrary illegal and malafide violating Article 14 19 (1) (g) and 21 of the Constitution of India and issue consequential direction directing the Respondent Nos.

1 and 2 to forthwith consider and act in pursuance of the representation/complaint made by the Petitioner dt 18.08.2018 and further direct the 1st Respondent not to prevent the Petitioner from entering into the Petitioners land at survey No. 513 to the extent of 600 sq yards i.e plot No 88, 89, 90 and 91 and also direct the 2nd and 3rd Respondents to forthwith order enquiry against the 1st Respondent with regard to his role in supporting the 4th Respondent to adopt illegal activities and preventing the Petitioner from entering into the Petitioners land to the extent of 600 sq. yards at survey No.513 and take appropriate action against the 1st Respondent."

Heard learned counsel for the petitioner and the learned Government Pleader for Home appearing for the respondent-police. 3.

Learned Assistant Government Pleader for Home produced written instructions, wherein it is stated that the compliant of the petitioner, dated 18.08.2018, was enquired into and submitted a detailed report before the Executive Magistrate-cum-Tahsildar, Nalgonda, requesting him to initiate Section 145 Cr.P.C. proceedings

to maintain peace and tranquillity at the disputed property in question. It is further stated that since the dispute between the petitioner and unofficial respondents is purely civil in nature, the respondent-police are no way concerned with the same. 4.

Recording the submissions made in the written instructions, the Writ Petition is disposed of leaving open the remedies available to the petitioner under law.
