HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.17145 of 2015 ORDER:

Vide the present petition, the petitioners seek direction thereby directing the respondents in not waiving the petitioners' crop loan by extending the G.O.Rt No.69 Agriculture & Cooperation Department, dated 13.08.2014, as illegal and arbitrary.

The petitioners are agriculturists belonging to Anajpur and Homantalapally Villagers of Chintapally Mandal, Nalgonda District. The petitioners got crop loans from the Mudhigonda Branch of Punjab National Bank in between the period from 2009 to 2012. The loan amount of the petitioners is below Rs.1 lakh. Meanwhile, the Government of Telangana issued G.O.Rt No.69 as noted above by making some guidelines to waive of crop loans which were taken from Telangana State. In the said G.O., appropriate instructions were issued to the concerned banks. As per the guidelines, all the banks in the State took steps for Crop Loans Waiver Scheme and were effected the scheme, by waiving of crop loan in 4 instalments by effecting 1/4th amount each year. As the concerned banks also giving fresh loans to the farmers, the petitioners have been benefited with this scheme.

It is further stated that in the state of Telangana, so many farmers are committed suicide because of their financial problems and for that reason only this G.O. was released. But the respondent bank is discriminating the petitioners on silly grounds which is unjust and unreasonable.

Learned counsel appearing on behalf of the petitioners submits that for the aforesaid relief, the petitioners and other farmers of the same village made representation to the District Collector, Nalgonda District5th respondent, vide receipt No.1911, dated 23.02.2015 for waiving of crop loan of the farmers. He further submits that there is no communication till date and the petitioners are in confusing state of mind whether they are entitled for waiving of crop loan or not.

Keeping in view the averments made in the instant petition, and the submissions of learned counsel for the petitioners, I hereby direct the 5th respondent to take decision on the representation made by the petitioners vide receipt as noted above, within two (02) weeks from the date of receipt of a copy of this order. The decision taken shall be communicated to the petitioner in writing within one week thereafter and to the respondents No.3 and 4 concerned bank.

Till a decision is taken and

communicated to the petitioner, no coercive steps shall be taken against the petitioner.

With the above direction, this Writ Petition is disposed of. No costs. Pending miscellaneous petitions, if any, shall stand dismissed.
