HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32842 of 2018 ORDER:

1) Heard.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 to 5 in interfering with the petitioner's peaceful possession and enjoyment of her property in Plot No.21-A, admeasuring Acs.178.5 square yards out of total extent of Ac.0.43 cents of land in Survey No.56/1, Bakkannapalem village, Madurava Sub-Division, Visakhapatnam Rural Mandal, Greater Visakhapatnam Municipal area, Visakhapatnam District, and taking steps to occupy the petitioner's property, without following due process of law, as illegal and arbitrary.

3) At the time when the matter is taken up for hearing, learned Government Pleader for Revenue would submit that the land of the petitioner in Survey No.56/1, Bakkannapalem village, Madurava SubDivision, Visakhapatnam Rural Mandal, Greater Visakhapatnam Municipal area, Visakhapatnam District, is adjacent to the Government land in Survey No.40 of the said village. It is stated that the said Survey number was sub-divided into various survey numbers and the same was handed over to different Government organizations. The petitioner is said to be the owner of the land in Survey No.56/1, which is also adjacent to Survey No.114 of the village and that the officials have inspected the land in Survey No.114, but never entered into the land of the petitioner.

4) Though learned counsel for the petitioner submits that some dump has been thrown into the land of the petitioner, the same is denied by the Government Pleader.

5) Having regard to the submissions made and the instructions placed on record, the respondents shall not interfere with the property of the petitioner in Plot No.21-A, admeasuring Acs.178.5 square yards out of total extent of Ac.0.43 cents of land in Survey No.56/1, Bakkannapalem village, Madurava Sub-Division, Visakhapatnam Rural Mandal, Greater Visakhapatnam Municipal area, Visakhapatnam District, except in accordance with law.
