O R D E R

As the dead body of the son of the petitioner by name Palle Shiva Reddy was found abutting the railway track near Maddirala Colony within the jurisdiction of Pedakakani Police Station, Guntur, on 2.12.2016, case in Cr.No.363 of 2016 was registered under Section 174 of Cr.P.C. and later based on FSL report, the section of law was altered to Section 302 IPC. Aggrieved by the inaction on the part of the respondent - police in conducting investigating, petitioner made representation dated 21.08.2017 to the 1st respondent - Government. As no action has been taken and the investigation is not completed and charge sheet is not filed, the present writ petition is filed.

Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home produced written instructions of Sub Divisional Police Officer, North Sub-Division, Mangalagiri, Guntur Urban District, dated 24.09.2018, stating that during the course of investigation, suspects were examined on different dates and that call data of the deceased was also analyzed, but no clues were found and that police are making hectic efforts to find the clues and that on completion of investigation, final report will be filed before the court as expeditiously as possible.

The offence alleged is of the year 2016 and the petitioner also stated to have made representation dated 21.08.2017 to the 1st respondent. However, in view of the statement made in the written instructions with regard to steps taken by the respondent - police in

conducting investigation, and recording the same, the writ petition is disposed of directing the 5th respondent - Station House Officer, Peda Kakani Police Station, Guntur District Andhra Pradesh, to take into consideration, the representation of the petitioner dated 21.08.2017, and complete the investigation as expeditiously as possible, and keeping in view the spirit of Section 173 of Cr.P.C., file appropriate report before the court concerned.

Interlocutory applications pending, if any, shall stand closed. No costs.
