Learned counsel for the appellant sought permission of this Court to withdraw the appeal.

Permission as sought for is accorded.

Accordingly, the M.A.C.M.A. is dismissed as withdrawn. The respondents, who are the claim petitioners before the lower Court, are permitted to withdraw the amount in deposit and to recover the balance amount, if any, by filing execution petition before the trial Court.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
