HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32804 of 2018 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus to declare the action of the 2nd respondent in not including the land admeasuring Ac.8-24 Guntas in Survey Nos. 17, 18, 19, 20, 50, 52, 61 to 63, 67 and 74 on par with the land admeasuring Ac.7-00 in Survey No.51, in the new pattadar pass book issued under Rythu Bandhu scheme, vide Khata No.205, as illegal, arbitrary and unconstitutional, and to include the land admeasuring Ac.824 guntas in the newly issued pattadar pass book under Rythu Bandhu scheme and also to pay Rs.4,000/ - as capital to the said extent on par with other Ac.7-00 of land in Survey No.51/ A, by duly considering the pending representation of the petitioner dated 19.05.2018.

The learned counsel for the petitioner would submit that though the petitioner has made a representation on 19.05.2018, for inclusion of the land admeasuring Ac.8-24 gunts in Survey Nos. 17, 18, 19, 20, 50, 52, 61 to 63, 67 and 74 on par with the land admeasuring Ac.7-00 in Survey No.51, in the new pattadar pass book, no orders have been passed on his representation as on today.

Learned Government Pleader would submit that a direction may be given to the appropriate authority to deal with the representation of the petitioner in accordance with law.

Having regard to the facts and circumstances of the case, the present writ petition is disposed of with consent, at the admission stage, directing the authorities to deal with the representation of the petitioner made for inclusion of the relevant survey numbers in the pattadar pass book, in accordance with law, after hearing all concerned, including the petitioner, as expeditiously as possible. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
