HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.20954 OF 2010 ORDER:

The petitioners seek writ of Mandamus declaring the action of the respondent in deducting the crop insurance premium from the crop loans of the petitioners at the rate of 1% to 12% towards crop insurance premium in the Kharif and Rabi seasons for the years 2010 to 2011 as illegal, arbitrary and violation of provisions of the Constitution of India and Contract Act and declare the same as optional but not compulsion.

When the matter came up for hearing, learned counsel for petitioners would submit that this Court in W.P.M.P.No.26671 of passed interim order on 24.08.2010 directing the respondents not to deduct the crop insurance premium from the petitioners in Kharif and Rabi seasons of 2010-2011 at the rate of 1% to 12% from the petitioners loans pending disposal of the writ petition. Learned counsel would submit that in view of the interim order, no final order need to be passed in the writ petition and hence, the same may be closed.

Recording the above submission, this writ petition is closed. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
