THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.25389 OF 2012 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to issue a writ of Mandamus to declare the action of respondent No.1 in not taking action against the illegal construction being made by respondent No.2 in premises bearing H.No.1-7-1129/2 situated at Advocates Colony, Near Hunter Road, Hanamkonda, Warangal District without any valid permission in spite of submission of written representation, dated 6.8.2012, as illegal and arbitrary and consequently, direct respondent No.1 to forthwith remove the illegal construction made by respondent No.2 in the said premises.

The main grievance of the petitioner in this writ petition is that in spite of the representation, dated 6.8.2012, of the petitioner, respondent No.1 is not taking any action to remove the illegal construction made by respondent No.2 in the aforesaid premises.

When the matter is posted for hearing, it is informed by the learned Standing Counsel appearing for respondent No.1 that the Corporation has already received a representation from respondent No.2 for regularisation of the building in question, which is unauthorisedly constructed, and the same is also under consideration and in view of the pendency of the said representation, respondent No.1 has not taken any action and that the representations of both the petitioner as well as respondent No.2 will be disposed of as expeditiously as possible.

Recording the submission of the learned Standing Counsel, the Writ Petition is disposed of. There shall be no order as to costs. 5.
Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
