HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36335 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in FIR No.327 of 2015 on the file of Tanuku Town Police Station, West Godavari District.

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that in view of the disputes between the petitioner and the complainant, the present complaint was lodged with false allegations.

The petitioner filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation. However, taking into consideration the facts and circumstances of the case and the grievance of the petitioner, this Court is of the view that the investigation can be completed without arresting the petitioner.

Accordingly, respondents Nos.1 and 2 are directed to complete the investigation and file a final report in FIR No.327 of 2015 on the file of Tanuku Police Station, West Godavari District, in accordance with law, without arresting the petitioner.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
