This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking his enlargement on bail in connection with Crime No.1032 of 2025 of Saroornagar Police Station, Rachakonda District. The offences alleged against the petitioner are under Sections 64(1) (m) of Bharatiya Nyaya

- 2 - Sanhita (2023) and under Section 6 of Protection of Children from Sexual Offences Act, 2023.

The prosecution case was that the de facto complainant lodged a police complaint on 30.09.2025, stating that her daughter became acquainted with the petitioner in 2024, which developed into a love affair. The petitioner allegedly promised to marry the victim, despite her objections as she was a minor and not of legal age to marry. He continued to communicate with her, and on 15.03.2025, when the complainant questioned her daughter about a delayed menstrual cycle, the victim disclosed that the petitioner had taken her to his house in Vijayanagar Colony, where he allegedly exploited her sexually, resulting in pregnancy. When confronted, the petitioner admitted to the relationship and pregnancy and promised to marry her. In March 2025 he took the victim to live with him until August 2025.

During that time, the victim reportedly called her mother, alleging mental harassment, physical assault, and denial of responsibility for the pregnancy. The complainant then brought her daughter back home. On 29.09.2025, when the victim contacted the petitioner via WhatsApp requesting for marriage, he allegedly abused her and her family in vulgar language.

Heard Sri Badra Nanavath, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations. In fact, victim is not a minor girl and whatever relationship between the parties is a consensual relationship. The petitioner and victim have already married with the consent of their families and they were also blessed with a baby child who is presently being looked after by the petitioner's family. No offence as alleged is committed by the petitioner and only to exploit him, a false case is registered against him. The petitioner is in jail from 01.10.2025. Hence, prayed this Court to grant regular bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that the offences alleged against the petitioner are heinous in nature and investigation is not yet completed. If petitioner is released on bail there is every chance

- 4 - of threatening the witnesses. As such, prayed this Court to dismiss this petition.

Considering the submissions made and a perusal of material on record, even according to the complainant, the victim went to the house of accused and stayed for considerable time and according to the petitioner they were also blessed with a baby girl who is under the care of petitioner. Petitioner is in jail from 01.10.2025. The record shows that Lws.1 to 9 are already examined. Considering the facts and circumstances, this Court is inclined to grant bail to the petitioner subject to the following conditions:

i.

The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of VIII Additional District & Sessions Judge, Ranga Reddy at L.B.Nagar ii.

The petitioner/Accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

The petitioner/Accused shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
