HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.165 of 2013 ORDER:

This writ petition is filed to declare the action of the respondents in constructing a garbage dumping yard in the residential area of the petitioner association at southern side boundary of the layout in and around Sy.No.972 of KPHB area as illegal and arbitrary. An interim direction was granted on 3.1.2013 directing the respondents to consider the representation of the petitioner dated 13.12.2012 and to pass appropriate orders thereon. Learned counsel for the petitioner submits that the representation of the petitioner association was disposed of. Today when the matter came up for hearing, learned counsel for the petitioner passed on a copy of the proceedings Lr.No.1059/AC (H&S)/EE (SWM)/GHMC/2013 dated 2.4.2013 addressed by the Additional Commissioner (H&S), Greater Hyderabad Municipal Corporation, Hyderabad, to the petitioner association. According to the said proceedings, the request of the petitioner association for shifting of the garbage transfer station constructed in Sy.No.972 of Kukatpally village, was rejected.

In view of the proceedings of the Additional commissioner, GHMC, Hyderabad, dated 2.4.2013, the Writ Petition is closed as no

further orders are necessary. However, it is open to the petitioner to avail appropriate remedies which are available under law. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ____________________________ KONGARA VIJAYA LAKSHMI, J Date: 03/12/2018 lkv
