ORDER

Heard learned counsel appearing for the petitioner, learned counsel appearing for the 5th respondent and learned Government Pleader appearing for respondents 1 to 4.

Challenging registration of Cr.No.326 of 2016 by the 4th respondent, the present writ petition is filed. It appears, based on the complaint lodged by the 5th respondent, the 4th respondent registered Cr.No.326 of 2016 on 26.09.2016. In the said complaint, it is alleged that the petitioner was behind the abuses made by A1 and A2 and the petitioner was shown as A3.

Learned counsel appearing for the petitioner submits that there were civil disputes between the de facto complainant and the clients of the petitioner and in view of the same, the present complaint was lodged implicating the petitioner also. On careful examination of the complaint, it does not show the direct involvement of the petitioner except alleging that he was behind the activities of A1 and A2, who were insulting the 5th respondent as stated above.

Admittedly, civil disputes are pending between the 5th respondent and A1 & A2.

In the circumstances, this Court is not inclined to interfere with the investigation. However, the petitioner shall not be arrested pursuant to the investigation, which may go on.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending, shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 7th March, 2017 rkk
