THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.14755 of 2025 ORDER:

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioners who are arrayed as accused Nos.12, 13, 19 and 47 in FIR No.39 of 2017 before the Bellampalli-I-Town Police Station, CID Regional Office, at Karimnagar District, registered for the offences punishable under Sections 420, 406, 120 (B) of IPC and Section 5 of AP Protection of Depositors and Financial Establishment Act1999 and Sections 4, 5, (a), (c) of the Prize Chits and Money Circulation Schemes (Banning) Act-1978 and Section 38 (2) of the Telangana State Mutually Aided Co-Operative Societies Act-1995.

The case of the prosecution is that on 03-03-2017 at 22:00 hours, the de-facto complainant lodged a report before the police stating that, about two years ago the AEGIS Parivar Co-operative Society opened a branch at Bellampalli Rama Talkies area by deputing the accused Nos.1 to 46 as the agents of the same society and collated daily and month deposits and not repaid the same after its maturity. Hence,

he requested for taking necessary action. On receipt of the said complaint, the Police registered case against the petitioners for the offences as alleged. Aggrieved thereby, this Criminal Petition is filed seeking anticipatory bail of the petitioners.

Heard Sri V. Yadu Krishna Sainath, learned counsel for petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for petitioners submitted that the entire allegations are against the C.M.D., Directors and Regional Managers who have not paid the deposited amount to the customers and there is no specific overtact against the Petitioners/Accused Nos. 12, 13, 19 and 47. It is further submitted that the petitioners are innocent of the alleged offences and have never committed any offence. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the

petitioners are serious in nature. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioners does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners herein are shown as agents and the petitioners are arrayed as accused Nos.12, 13, 19 and 47. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to compliance of the following conditions: i.

The petitioners shall surrender before the Station House Officer, CID Regional Office, at Karimnagar District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail, on petitioners executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only),

with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
