HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6009 of 2015 ORDER:

This criminal petition, under section 438 of the Code of Criminal Procedure, is filed by the petitioner-Accused No.2 seeking grant of anticipatory bail in CC No.146 of 2015 on the file of the XIV Additional Chief Metropolitan Magistrate at Hyderabad, arising out of Crime No.796 of 2013 of Punjagutta Police Station, Hyderabad, registered for the offences punishable under Sections 420, 417, 313, 315, 376(D), 506, 509 and 384 read with 34 IPC.

Heard and perused the material available on record. Learned counsel for the petitioner submitted that the other accused were granted anticipatory bail and investigation was already completed and the charge sheet has also been filed and the Court below took cognizance of the case and numbered it as CC No.146 of 2015. He further submitted that as the petitioner was shown as absconding, the Court below issued NBW against the petitioner. Considering the facts and circumstances of the case, the petitioner is directed to surrender before the trial Court and file an application to recall the NBW issued against hem. On filing of such application, the trial Court is directed to recall the warrant on the same day on condition of petitioner executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for the like sum for her future appearance before the trial Court.
