HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.33356 OF 2018 ORDER:
This petition is filed for a writ of Mandamus declaring the action of the 4th respondent in calling the petitioner to the police station at the behest of 5th respondent in relation to Crime No.303/2017 registered on the file of the 3rd respondent for the offences under Section 406, 420 of IPC and Section 24 of Immigration Act and in threatening the petitioner to pay the amount to the 5th respondent, without any authority or jurisdiction, as illegal and arbitrary.
Learned Assistant Government Pleader for Home produced written instructions wherein it is stated that Crime No.303/2017 was closed at the first instance and later the same was reopened and investigation is pending. It is also stated that A6 who is the brother of petitioner is absconding, as such, a special team was also constituted for apprehending him.
Recording the aforesaid written instructions the writ petition is disposed of directing the respondent police not to harass the petitioner and to call the petitioner only for the purpose of investigation as and when his presence is required. However, this order will not come in the way of respondent police in investigating with the crime. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
