THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7596 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue an appropriate writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondents in not providing suitable alternative employment as Record tracer/ Shramik etc., and paying the salary from 15-09-2014 to 21-01-2015 to the petitioner is illegal, arbitrary and contrary to the A.P.S.R.T.C. Service Regulations, circulars and the provisions of Act, 1 of 1996 the persons with Disabilities (Equal, Opportunities, Protection of Rights and Full Partition) Act, 1995 and as well violation of Fundamental Rights guaranteed under the constitution of India and consequently direct the respondents to provide suitable alternate employment as Shramik as per Section 47 of the Act 1/1996 and pay salary from 15-09-2014 to 21-01-2015 with all other attendant service benefits and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. Heard Sri A.Jagan, learned counsel, appearing for the petitioner and learned standing counsel for the respondent Corporation.

During the course of hearing, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein may be permitted to submit a representation before the respondents herein and the same may be directed to be disposed of by the respondents, in accordance with law, by fixing some timeframe. The said request is not opposed by the learned standing counsel appearing for the respondents.

4. In view of the above, Writ Petition stands disposed of, without expressing any opinion on the merits and demerits of the matter and

entitlement of the petitioner, keeping it open for the petitioner herein to submit a representation to the respondents herein for redressal of his grievance, within a period of one week from the date of receipt of a copy of this order and if any such representation is made within the time stipulated, the same shall be considered and appropriate orders be passed, in accordance with law, within a period of two months from thereafter.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 10.03.2016 SS
