THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22832 OF 2016 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for Home. With consent of the counsel appearing for both parties, the present Writ Petition is disposed of at the admission stage.

2. Since this Court is not adjudicating the matter on merits, hearing of the unofficial respondent may not be necessary.

3. The present Writ Petition is filed with the following prayer: "to issue writ order or direction, more particularly one in the nature of writ of mandamus declaring the action of respondents 2 and 3 in not completing the investigation in Crime No.95 of 2014 on the file of B.Mattam Police Station, as illegal, arbitrary and contrary to law and consequently direct the respondents to complete the investigation and to file charge sheet into Court."

4. The grievance of the petitioner is that in spite of registering a crime for the offences punishable under Sections 147, 148, 447, 324 read with 149 IPC, on 22.07.2014, basing the on the report lodged by the 1st petitioner herein, the respondents-police are neither proceeding further with the investigation nor initiating any appropriate action against the accused.

5. Learned Government Pleader for Home submits that the investigation is going on and charge sheet will be filed at the earliest.

6. Having regard to the above, the Writ Petition is disposed of directing the 3rd respondent-Station House Officer, B.Mattam Police Station, YSR District, to complete the investigation in Crime No.95 of 2014 and file charge sheet as early as possible preferably within a period of three (03) months from the date of receipt of a copy of this order.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
