THE HONB'E SRI JUSTICE CHALLA KONDANDA RAM WRIT PETITION No.10922 OF 2017 ORDER:
The writ petition is filed challenging the order dated 06.03.2017 passed by the 3rd respondent Commissioner.
It is the case of the petitioner that aggrieved by the order dated 06.03.2017, passed by the 3rd respondent Commissioner, petitioner had filed an appeal under Section 345 of the Hyderabad Municipal Corporation Act, 1955 before the 2nd respondent Municipal Council on 21.03.2017 along with the stay petition.
Inasmuch as the petitioner had already invoked the appellate jurisdiction and filed the appeal along with the stay petition, the interest of justice would be served, if a direction is given to the 2nd respondent, to pass orders on the appeal or in the stay petition after considering the case of the petitioner on merits. Accordingly, the writ petition is disposed of directing the 2nd respondent-Municipal Council, to pass orders either in the appeal or in the stay petition, in accordance with law, within a period of four weeks from the date of receipt of copy of the order. Till such time orders are passed either on the appeal or on the stay petition, the impugned order stands suspended. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand disposed of as infructuous. ___________________________ CHALL KODANDA RAM,J Date:28.03.2017.
