HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5458 OF 2015 ORDER:

This Criminal Petition is filed by the petitioners/A2 and A3 under Section 482 Cr.P.C seeking to quash the proceedings in crime No.155 of 2012 on the file of PS, Tukaram gate, Secunderabad, registered for the offences punishable under Sections 498-A and 306 I.P.C.

Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the State, before notice to respondent No.2/de facto complainant and before admission.

Perused the material on record. As the material on record falls short for this Court to admit the application under Section 482 Cr.P.C, this petition is disposed of giving liberty to the petitioners to surrender before the learned Magistrate concerned and move for regular bail with notice to Additional Public Prosecutor and in such an event the learned Magistrate after hearing shall grant bail to them on the same day with necessary conditions. Needless to say, at the post bail stage pending investigation, presence of all the accused can be dispensed with. Any remedy is left open to the petitioners, in the event of

police filing a final report and taken cognizance. Accordingly, this criminal petition is disposed of. Miscellaneous petitions pending if any, shall stand closed.
